CITY COMMISSION MEETING

April 5, 2021

This Commission Meeting was conducted utilizing Communications Media Technology.  Some Staff members were present in the Commission Chambers while others were present via the Zoom application to respect the social distancing guidelines.

1.    Mayor Bryant called the meeting to order at 7:01 p.m., followed by a moment of silence and the Pledge of Allegiance.

 

All person intending to address the City Commission were duly sworn.

 

2.     PROCLAMATION:         Commissioner Williams presented the Sexual Assault Awareness Day Proclamation                                                   to Catherine DeGendice of Centerstone.

 

3.     PROCLAMATION:           Commissioner Varnadore presented the Child Abuse Prevention Month                                                                       Proclamation to Jamie Howell of Manatee Children’s Services.

 

4.   CITY COMMISSION AGENDA APPROVAL

 

                 Motion:  Commissioner Varnadore moved, Commissioner Williams seconded, and the                                                   motion carried 5-0 to approve the April 5, 2021 City Commission Meeting                                           Agenda with the additions of item 6.G, Special Function Permit 14th Annual                                                     Fire Charity Fishing Tournament, and item 12.A, Celebration Center that was                                            discussed today at the Commission Workshop at 4:30 p.m.

5.  PUBLIC COMMENT

 Mr. Gause spoke about the Crosthwait Fishing Tournament that has been going on since 1983 and run by volunteers.  He stated that the Bradenton Police volunteers to take veterans out fishing on the Bradenton Police boat and wants to extend an invitation to the City of Palmetto Police to participate.   Mayor Bryant requested a motion from the Board.

 

                        Motion:  Commissioner Varnadore moved, Commissioner Williams seconded, and the motion carried

                                                   5-0 to approve the City of Palmetto Police to participate in the Project Healing Waters                                                                    portion of Tournament.

 

 Mr. Contarino, R Cubed Engineering LLC, inquired about when the paperwork for the property that was purchased by his business will be completed.  Mr. Burton, CRA Director, stated that he will check on it and get back with him.

 

  Mrs. Caramanti, resident, reported that there is a sign posted advertising affordable housing for seniors at Riviera Dunes, and it is in error. 

 

The below residents voiced their concerns about countless boat parking spaces that will be eliminated if the vacant lot across the street from the boat ramp is sold for development.

 Shay Hawkinberry, via telephone into Zoom Meeting, Riviera Dunes, commented that the public speaker has confused the affordable housing sign on Haben Boulevard across from the Manatee School of Arts with Riviera Dunes, and it is not.  Mayor Bryant asked that Mrs. Owens, Development Services Director, will speak on the inaccuracy when the item for Riveria Dunes occurs on the agenda.    

 

 Glen Gibellina, via telephone into Zoom Meeting, commented on the affordable housing industry.

                 Motion:  Commissioner Varnadore moved, Commissioner Cornwell seconded, and the                                        motion carried 5-0 to approve the Consent Agenda as presented by staff                                         with the removal of items 6.E, 6.F, and 6.G for discussion.

 

6.E  Resolution 2021-10 Budget Amendment Park Improvements Discussion

Mr. Freeman explained this establishes the budget for Sutton Park playground and the Celebration Center pending Commission’s action.

 

                        Motion:  Commissioner Cornwell moved, Commissioner Williams seconded, and the                                                   motion carried 5-0 to approve Consent Agenda item 6.E as presented by                                          staff.

 

6.F  Acquisition of Deeds From Manatee Fruit Company at 17th Street West and 24th Avenue West Discussion

Commissioner Cornwell asked for an overview of the transfer.

 

                        Motion:  Commissioner Cornwell moved, Commissioner Smith seconded, and the motion                                                          carried 5-0 to approve Consent Agenda item 6.F as presented by staff.

 

6.G  14th Annual Fire Charity Fishing Tournament

Mr. Freeman gave a brief overview of the event.

 

                        Motion:  Commissioner Cornwell moved, Commissioner Jones seconded, and the motion                                                          carried 5-0 to approve Consent Agenda item 6.G as presented by staff.

 

7.    FIRST READ ORDINANCE 2021-05 GLIDDEN REZONING (K. Owens)

AN ORDINANCE OF THE CITY OF PALMETTO, FLORIDA, REZONING APPROXIMATELY 7,392 SQUARE FEET OF PROPERTY GENERALLY LOCATED AT 518 & 520 7TH AVENUE WEST, PALMETTO FLORIDA, FROM R-6,   MULTI-FAMILY, TO PD-H, PLANNED DEVELOPMENT-HOUSING, AS MORE PARTICULARLY DESCRIBED IN THIS ORDINANCE; PROVIDING FOR SEVERABILITY, AND EFFECTIVE DATE.

 

Motion:  Commissioner Cornwell moved, Commissioner Varnadore seconded,                                     and the motion carried 5-0 to approve the first reading of Ordinance                                       2021-05 and authorize staff to advertise same for the appropriate Public                                    Hearing.

 

8.    FIRST READ ORDINANCE 2021-03 GLIDDEN GENERAL DEVELOPMENT PLAN (K. Owens)

AN ORDINANCE OF THE CITY OF PALMETTO, FLORIDA, PROVIDING FOR FINDINGS OF FACT; APPROVING ADOPTION OF A GENERAL DEVELOPMENT PLAN AS DESCRIBED HEREIN FOR A PLANNED DEVELOPMENT CONTAINING ONE DUPLEX UNIT ON 7,392 SQUARE FEET OF PROPERTY GENERALLY LOCATED AT 518 & 520 7TH AVENUE WEST, PALMETTO, FLORIDA; PROVIDING FOR SEVERABILITY, AND AN EFFECTIVE DATE.

                 Motion:  Commissioner Cornwell moved, Commissioner Williams seconded, and the                                       motion carried 5-0 to approve the first reading of Ordinance 2021-03 and                                                                                      authorize staff to advertise same for the appropriate Public Hearing.

 

9.    FIRST READ ORDINANCE 2021-04 RIVIERA DUNES APARTMENTS GENERAL DEVELOPMENT PLAN (K. Owens)

AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF PALMETTO, FLORIDA, PROVIDING FOR FINDINGS OF FACT; APPROVING ADOPTION OF A GENERAL DEVELOPMENT PLAN AS DESCRIBED HEREIN FOR A MULTI-FAMILY, PLANNED DEVELOPMENT CONTAINING 262 MULTI-FAMILY RESIDENTIAL UNITS ON 8.37 ACRES OF PROPERTY GENERALLY LOCATED ALONG THE EAST SIDE OF U.S. 41 SOUTH OF HABEN BOULEVARD AT THE WESTERN ENTRANCE TO THE RIVIERA DUNES DEVELOPMENT; PROVIDING FOR CONFLICT, SEVERABILITY, AND AN EFFECTIVE DATE.

 

               Motion:  Commissioner Cornwell moved, Commissioner Varnadore seconded,                                                          and the motion carried 5-0 to approve the first reading of Ordinance                                                                                             2021-04 and authorize staff to advertise same for the appropriate Public                                                                                           Hearing.

 

10.   PUBLIC HEARING CONDITIONAL USE 2021-01 CELL PHONE TOWER (K. Owens)

FINAL ORDER OF THE CITY COMMISSION FOR THE CITY OF PALMETTO, FLORIDA, APPROVING CONDITIONAL USE PERMIT NO# CU 2021-01, FOR CONSTRUCTION OF A 150 FOOT MONOPOLE TELECOMMUNICATION TOWER ON THE PROPERTY LOCATED AT 1550 U.S. 301 NORTH, UNIT #5, IN PALMETTO, FLORIDA.

 

Mayor Bryant opened the Public Hearing at 8:24 p.m.

 

Mayor Bryant closed the Public Hearing after comments at 8:35 p.m.

 

After substantial discussion, the Board decided that additional technical and specific data was essential before voting and recommended that the item be continued for another Commission Meeting.   

 

                                Motion:  Commissioner Varnadore moved, Commissioner Williams seconded, and the                                              motion carried 5-0 to continue Conditional Use 2021-21 Cell Phone Tower to                                                the June 7, 2021 City Commission Meeting.

 

11.    PUBLIC HEARING RESOLUTION 2021-07 DISPOSITION OF CITY PROPERTY FOR AFFORDABLE HOUSING (K. Owens)

RESOLUTION BY THE CITY COMMISSION OF THE CITY OF PALMETTO, FLORIDA APPROVING THE AFFORDABLE HOUSING VACANT LAND INVENTORY LIST OF CITY- OWNED PROPERTY APPROPRIATE FOR USE AS AFFORDABLE HOUSNG PURSUANT TO SECTION 166.04551, FLORIDA STATUTES; PROVIDING FOR AN EFFECTIVE DATE.

Mayor Bryant opened the Public Hearing at 9:21 p.m.

 

Mayor Bryant closed the Public Hearing after no public comments at 9:24 p.m.

 

 

               Motion:  Commissioner Varnadore moved, Commissioner Cornwell seconded, and the                                                motion carried 5-0 to adopt Resolution 2021-07.

 

12. PUBLIC HEARING ORDINANCE 2021-01 GENERAL EMPLOYEE PENSION INTERNAL REVENUE CODE CHANGES (J. Freeman)

AN ORDINANCE OF THE CITY OF PALMETTO AMENDING CHAPTER 22, PERSONNEL, ARTICLE IV, GENERAL EMPLOYEES' RETIREMENT SYSTEM, OF THE CODE OF ORDINANCES OF THE CITY OF PALMETTO; AMENDING SECTION 22-86, BENEFIT AMOUNTS AND ELIGIBILITY; AMENDING SECTION 22-87, PRE-RETIREMENT DEATH; AMENDING SECTION 22-90, OPTIONAL FORMS OF BENEFITS; AMENDING SECTION 22-95,MINIMUM DISTRIBUTION OF BENEFITS; AMENDING SECTION 22-109, REEMPLOYMENT AFTER RETIREMENT; PROVIDING FOR CODIFICATION; PROVIDING FOR SEVERABILITY OF PROVISIONS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE.

 

Mayor Bryant opened the Public Hearing at 9:25 p.m.

 

Mayor Bryant closed the Public Hearing after no public comments at 9:26 p.m.

 

 

               Motion:  Commissioner Cornwell moved, Commissioner Williams seconded, and the                                                       motion carried 5-0 to adopt Ordinance 2021-01.

 

 

12. A  CELEBRATION CENTER DISCUSSION

This item is a continuation from today’s Workshop Meeting at 4:30 p.m. 

 

                  Motion:  Commissioner Williams moved, Commissioner Smith seconded for discussion, and the                                                                    motion carried 5-0 to authorize the surplus of the Celebration Center in the event there is                                      not a successful bidder to authorize the demolition of the building.

 

Discussion continued.

 

Amended Motion:  Commissioner Smith moved, Commissioner Williams seconded, and the motion carried 5-0 to                                    approve the amendment to the original motion to authorize the surplus of the Celebration                                        Center in the event there is not a successful bidder to authorize the demolition of the building.

  Amended Motion:  Commissioner Smith moved, Commissioner Williams seconded, and the motion carried                                                                   4-1 to authorize the surplus of the Celebration Center in the event there is not a                                                                      successful bidder to authorize the demolition of the building with the intention to replace                                      the Celebration Center.  Commissioner Cornwell voted nay.

 

 

Mayor Bryant recessed the City Commission Meeting at 9:30 p.m. to open the April 5, 2021 CRA Board Meeting

 

 

Mayor Bryant reconvened the City Commission Meeting at 9:51 p.m.

 

13.  CRA ANNUAL REPORT (J. Burton)

 

               Motion:  Commissioner Varnadore moved, Commissioner Cornwell seconded, and the                                                 motion carried 5-0 to approve the 2020 Palmetto CRA Annual Report.

COMMENTS:

 

16.   DEPARTMENT HEADS COMMENTS

Chief Taylor stated that the issue concerning the Lone Oak Mobile Home Park and the crossing at Lincoln was resolved.  Also, he applied for the $20,000 West Coast Inland Navigational District (WCIND) Grant for the removal of derelict boats, and the item will be on the April 20th County Commission Meeting Agenda. 

 

               Motion:  Commissioner Williams moved, Commissioner Varnadore seconded, and the motion                                                       carried 5-0 to ratify Chief Tyler’s application for the $20,000 WCIND Grant.  

 

Chief Tyler also thanked the Board for supporting the City of Palmetto Police to participate in the Project Healing Waters, Crosthwait Fishing Tournament.

 

Mr. Burton, CRA Director, expressed that the approved CRA Annual Report will be forwarded to Manatee County within 10 days.

 

Mr. Rayan, PWD, gave an update on the below projects:

·         US 301 and Canal Road traffic light operating

·         Veolia Rebate $65,000 check for wastewater treatment

·         MLK Project bids going out

·         Chloramine House moving forward to become operational soon. 

·         Attorney Barnebey stated that PBA negations will start this month.

17.    MAYORS REPORT

Mayor Bryant gave an update on the wastewater spill at Piney Point. 

 

18.   COMMISSIONERS COMMENTS

Commissioner Jones inquired about the City paving the roads in-house.  Mr. Rayan, PWD responded that the issue was discussed recently doing smaller projects in-house and is gathering more information. 

 

A motion was made to extend the meeting to 10:10 p.m.

 

                                Motion:  Commissioner Williams moved, Commissioner Smith seconded, and the motion was                                                              carried 5-0 to extend the meeting to 10:10 p.m.

 

Commissioner Jones questioned an incident that occurred at the Race Trac Gas Station in Palmetto.  Chief Tyler and Attorney Barnebey expressed that it could not be discussed publicly since it is an on-going investigation.

 

 Commissioner Varnadore inquired about reaching out to the County about the boat ramp comments and requested that the staff look into pickleball courts for the parks.

 

 Commissioner Cornwell asked if water testing and treatments are being done, and Mr. Rayan, PWD, replied that it is done daily.

 

 Commissioner Williams thanked Mayor Bryant on the Piney Point update and suggested that Mr. Rayan provide information on how Piney Point could affect the City in the future.
